These terms explain the rules for using WishJoy at wishjoy.in (the “Service”), operated by WishJoy, Uttar Pradesh, India (“we”, “us”, “our”). By using the Service you agree to these terms and to our Privacy policy. If you do not agree, please do not use the Service.
1. Who can use the Service
You must be at least 18 years old, or use the Service with the involvement and consent of a parent or legal guardian. You must not use the Service if the law prevents you from doing so.
2. Creating surprises
You can create surprise pages without an account. Your browser remembers the surprises you make and you receive a private edit link. If you clear your browser data and lose your edit link, we may not be able to restore access. A free account lets you keep your surprises across devices. You are responsible for keeping your password and edit links safe.
3. Your content
You keep ownership of the words, photos and audio you add (“Your Content”). You give us a limited, non-exclusive, royalty-free licence to store, copy, process and display Your Content only to operate the Service, for example to show your surprise to the people you share it with. This licence ends when you delete Your Content, except for backup copies that are removed in the normal course of operations.
You confirm that you own Your Content or have permission to use it, including photos of other people and any music, and that it does not break any law or these terms.
4. Content you must not upload
- Anything illegal, or that encourages illegal activity.
- Sexual or obscene content, and absolutely any content that sexualises or endangers children.
- Harassment, threats, hate speech, or content that insults or targets a person or group, including on the basis of religion, caste, gender or ethnicity.
- Private information about someone without their consent, or content that invades another person’s privacy.
- Photos, music or other material you do not have the right to share.
- Content that impersonates another person or brand, or misleads people about who made it.
- Phishing, malware, scams, spam or anything that threatens the security of the Service or India’s laws and public order.
5. Music and copyright
Built-in tunes are generated in the browser and are free to use. If you upload a song, you confirm you own it or have permission to share it. We respect intellectual property. If you believe content on the Service infringes your rights, email hello@wishjoy.in with the surprise link, a description of your work and your contact details, and we will remove infringing material promptly.
6. Privacy settings and sharing
Private surprises are visible only to you. A public surprise can be opened by anyone who has the link. A surprise protected by a secret code can be opened by anyone with the link and the code. Surprise links are long and random and we ask search engines not to index them, but we cannot control what people do with a link after you share it.
7. Moderation and reports
Anyone can report a surprise. We may review, hide or remove any surprise, disable sharing links or suspend accounts that break these terms or the law, with or without notice. Where the law requires, we may preserve information and share it with the relevant authorities.
8. Grievance redressal
In line with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you can raise a complaint about content on the Service or about these terms with our Grievance Officer:

We acknowledge complaints within 24 hours and aim to resolve them within 15 days. Complaints about content that shows a person in a sexual or intimate way without consent, or that impersonates them, are acted on within 24 hours.
9. A free service, provided as it is
The Service is free and provided “as is” and “as available”. We do not promise it will always be available, error free or that content will never be lost. Please keep your own copies of photos and messages that matter to you.
10. Limitation of liability
To the extent allowed by law, we are not liable for any indirect or consequential loss, or for loss of data, arising from your use of the Service. Nothing in these terms limits liability that cannot be limited under Indian law.
11. Your responsibility
You agree to compensate us for reasonable losses and legal costs caused by Your Content or by your breach of these terms.
12. Ending your use
You can stop using the Service at any time and delete your surprises and account from the Account page. We may suspend or end access for anyone who breaks these terms.
13. Changes
We may update these terms. If changes are significant, we will show a notice on the website. Continuing to use the Service after changes means you accept them.
14. Governing law
These terms are governed by the laws of India. Courts at Uttar Pradesh, India have exclusive jurisdiction over any dispute.
